UF proposes constitutional inquiry terms of reference

United Future leader Peter Dunne today proposed terms of reference for a Royal Commission of Inquiry into New Zealand’s future constitutional arrangements.

They are:

1. Whether New Zealand should codify its collection of constitutional documents and conventions into a written constitution expressed in a single document.

2. Whether, were New Zealand to adopt a written constitution, other laws may be tested for consistency in the Courts.

3. What the future role is of the Crown in the New Zealand Constitution.

4. What the present and future place is of the Treaty of Waitangi.

5. Whether there are discernable principles of the Treaty of Waitangi; if so, how should they be recognised.

6. Whether, irrespective of the way New Zealand’s constitution is changed in form or expression, there should be any restrictions on historical grievances or claims brought under the Treaty of Waitangi.

7. Whether Waitangi Day ought remain New Zealand’s national day.

8. Whether separate representation for Maori in Parliament continues to be necessary.

9. Any other question relevant to establishing the most appropriate future constitutional direction for New Zealand.

“These terms of reference will help the country meeting the changing circumstances that confront us all as we move into the 21st century,:” said Mr Dunne.
