Copeland disputes Conservation Minister's legal position
United Future's Gordon Copeland today disputed Conservation Minister Chris Carter's interpretation of his own Act, after Mr Carter claimed that the Dobson Dam power proposal could not proceed because it involves part of the Card Creek ecological area.
"My reading is that the Conservation Act is fairly straightforward. It both allows the Minister to declare an ecological area and to vary or revoke that purpose. So where is the problem?"
The legal position is covered under Section 18 of the Conservation Act 1987. Subsection 1 creates an ecological area and subsection 7 permits its revocation.
