Turners & Growers to appeal High Court ruling over Zespri's use of market power

Sept. 12 (BusinessDesk) - Turners & Growers Ltd., the fruit marketer controlled by Guinness Peat Group, is appealing against a High Court decision to throw out its claims that Zespri Ltd. has abused its power as the kiwifruit exporting monopoly.

Managing director Jeff Wesley said the company's board and legal team had taken advice from their counsel that "errors were made in the judgment and that it should be taken to the Court of Appeal.”

Turners & Growers says it wants the right to export its own kiwifruit varieties but that Zespri stifled market competition by only commercialising its own cultivars.

Turners & Growers has annual sales of fresh produce of about $1 billion and owns the Enza brand, the nation's largest apple exporter.
