ARC Admits It Cannot Demand Payment Within 14 Days

ARC ADMITS IT CANNOT 'DEMAND' PAYMENT WITHIN 14 DAYS.

COMPLETE COPY OF LEGAL ADVICE REQUESTED.

Statement from David Thornton

ARC chair Gwen Bull has responded to our challenge that the council cannot enforce its demand to pay rates "Within 14 Days".

In a letter to me she confirms that the council can only send letters - and no legal action can be taken before a date four months after the rates were due.[That is 7th December for North Shore and Rodney (non) ratepayers]

We have also asked Mrs Bull to reconsider the ARC's refusal to provide us with copies of legal advice it has received on its ability to charge penalties.

We have already asked the Ombudsman to look into that issue.

Meanwhile we are collating 'case histories' in which it is becoming apparent that the ARC is receiving many letters of complaint concerning its refusal to accept payment by instalments other than direct debit.

These case histories are being considered for use in any future legal action.

The REBELLION 'High Command' meets this afternoon to review current activities and plan the next phases of the campaign.
