Swimming Pool Fencing: Legal Impossibility

Press Release :- Pool Owners Action Group
http://poag.org.nz/

In a Press Release on 8 December 2004, I alluded to a looming logistics problem with the large number of cases Waitakere City Council has brought against its pool owners.

A number of these pool owners have already received several notices of adjournment , dating back to September 2003.

Currently there are 17 Status hearings set down for May and a further 63 fully defended hearings all to be heard by the same judge on the same day, 17 June.

At a Council meeting on 24 November 2004, a Swimming Pool Exemption Committee was set up. Since then, it has considered 3 cases. I understand 2 of those have been given exemptions.

Tomorrow, the Exemption Committee is to consider 4 further cases. Thereafter, there are meetings scheduled for 15 April, 29 April, 13 May, 27 May, 10 june, 24 June.

Assuming everyone who has an exemption hearing between 1 April and 1 June, receives an exemption, the number of exemptions given in that period, on the basis of 4 per meeting, will be 20.

Allowing for the 2 exemptions already given, that gives a total of 22 and still leaves 41 defended hearings to be heard on the same day.

---AN IMPOSSIBLE SITUATION!!!
