Changes To Animals, Cemeteries, Libraries And Recreation Centre, Noise And Billiard Room Bylaws

Changes to the rules for the number of animals people can keep on properties in urban areas have been approved by Manukau City Council.

The changes were made in the first stage of a review of all council bylaws to make sure they are still the most appropriate way to address a problem. The review, which is required by government, has to be complete by 30 June 2008.

Approved at last Thursday’s Manukau City Council meeting were new bylaws for Animals and Pest Management, Cemeteries and Crematoria, Libraries, and Recreational and Cultural Facilities. The old noise and billiard room bylaws were revoked because the council can deal with associated problems through other legislation or agencies.

The new Animals and Pest Management Bylaw comes into force on 1 July 2007, until then the current rules will remain in place.

The bylaw won’t restrict the number of cats, caged birds and pigeons that can be kept on urban properties as long as they don’t create a nuisance. Up to 12 chickens can be kept, however a range of other animals including roosters, ducks, horses, sheep and cows won’t be allowed in urban areas.

People wishing to keep more than the permitted number of animals on their urban properties can apply to the council for a permit.

Hearings Committee Chair Jan Sinclair says substantial changes were made to rules proposed in the draft bylaw following public feedback.

“For example the proposals to restrict the number of cats, caged birds and pigeons were removed. Controls on the driving and grazing of stock were also changed to address the concerns of farmers.

"The rules for what animals can be kept in suburban backyards are now relevant for 2006 and beyond. It should also ensure animals don't create a nuisance or damage to property," says Cr Sinclair.

New bylaws for the management of cemeteries, libraries and recreational and cultural facilities will come into force on 30 November. There are no major changes to the management of these facilities, except children under 10 using council swimming pools will require supervision by a person 16 or over.

Reviews of other council bylaws, including Street Traders, Brothels, Public Places and Food Hygiene, will be presented to full Council in December for public notification in February 2007.
