Manners Mall Environment Court Decision

A Wellington busker, Benjamin Easton will file for a judicial review against the Environment Court’s decision of 15 April 2010 dismissing the City is Ours Incorporated appeal to stop the revocation of Manners Mall. He says he will file these proceedings as an individual who spoke to the appeal, claiming that evidence proving that the design plan cannot possibly work was clearly overlooked by the Court.

“Judge Thompson unreasonably shut down a submission made to the Court, and before this critical evidence could be presented. He then failed to reason in the judgment against its absolute logic as it was then limited to a written and closing submission” says Mr Easton.

Simply put, the present design is fatally flawed and cannot work. He states it will cause the southern bound route to gridlock immediately from when one bus moves into the centre lane on Manners Street west, queuing to turn right into Victoria Street from the intersection. General traffic sharing the route and the 7, 8 and 9 buses can only turn right by using the busy centre lane and if any right turning vehicle is behind the first queuing bus, all other routed buses cannot get through on the inside lane until the centre lane is freed up.

Dr Wayne Stewart of Opus International Consultants who were extensively consulted on the proposal was not available for comment.
