Court of Appeal decision - Harbourview-Orangihina

Auckland Council welcomes today’s Court of Appeal decision that Auckland Council is not required to offer the park land at Harbourview-Orangihina on the Te Atatū Peninsula back under the Public Works Act to descendants of the original owners.

The court found that offering the land now to the owners and their litigation funder would allow them “to take at the council’s expense the benefit of windfall profits”.

Auckland Council’s current plans for the site are set out in the Proposed Auckland Unitary Plan, where the land is zoned for Open Space. There is also a small portion of land zoned Special Purpose Māori Zone.
