Court of Appeal requires Commerce Commission
changes to Kupe case

AUCKLAND 31 July 2000 – The Commerce Commission was today ordered by the Court of Appeal to amend the Statement of Claim it lodged nearly three years ago over its Kupe gas field case against ECNZ, Fletcher Challenge Ltd, Fletcher Challenge Energy and Genesis Power Ltd.

In its decision the Court required the Commerce Commission to make three changes before the case could return to the High Court for a substantive hearing. The Court also ordered the Commerce Commission to pay costs.

“Today’s decision simply settled some procedural matters at the Commerce Commission’s expense,” Fletcher Challenge Energy spokesperson, Stephen Jones said. “The case still has to proceed to a full trial. Fletcher Challenge is strongly convinced that the Commission’s case has no foundation.”
