Property Institute Announces Land Valuation Trib.

PROPERTY INSTITUTE ANNOUNCES LAND VALUATION TRIBUNAL MEMBERS
The New Zealand Property Institute today announced the recent appointments made by the Government to various Land Valuation Tribunals.
NZPI CEO Conor English said today, "The Land Valuation Tribunal performs an important function in the economy. The Institute is proud that we have such high caliber and professional people to contribute to these Tribunals." The appointments that the Government made were as follows:
* the reappointment of Kenneth George Stevenson FNZPI, and the appointment of John Winston Charters FNZPI, each as a member of the Auckland Land Valuation Tribunal. *
* the appointments of (David) Graeme Black SNZPI, and Ngarangi Aroha KAA, each as a member of the Gisborne Land Valuation Tribunal.
* the reappointment of William Jens Harvey FNZPI, as a member of the Hawke's Bay Land Valuation Tribunal.
* the appointments of Anthony William Gowans FNZPI and Alexander Charles Hayward FNZPI, each as a member of the Nelson Land Valuation Tribunal.
* the reappointment of William Owen Harrington FNZPI and the appointment of John Dunkley FNZPI, each as a member of the Otago Land Valuation Tribunal.
* the appointment of Stephen William George Binnie SNZPI as a member of the South Canterbury Land Valuation Tribunal.
* the appointments of David Smyth FNZPI and Vance Winitana, each as a member of the Waikato No 1 Land Valuation Tribunal.
* the reappointment of William Alan Cleghorn FNZPI as a member of the Waikato No 2 Land Valuation Tribunal.

Some background of Land Valuation Tribunals:
Under s19 (2) of the Land Valuation Proceedings Act, Land Valuation Tribunals are constituted at a number of locations. Each tribunal consists of:
One member, a District Court Judge, who shall be appointed as Chairperson of the Tribunal Two other members, one or both of whom shall be valuers registered under the Valuers Act 1948
The members appointed under (2)(b) of s19, are appointed for a term not exceeding six years, and are eligible for reappointment.
Tribunals must sit with a Chair and at least one other member (s 6); it generally sits with the Chair and two members.
Tribunals have jurisdiction to determine the value of land under a number of Acts. The significant ones include:
* The Ratings Valuations Act 1998: Tribunals deals with appeals from local authority rating valuations. These cases form the bulk of the tribunals work
* The Public Works Act 1981: Tribunals have jurisdiction to determine the value of land for the purpose of compensation when land has been taken for public works. This is rarely exercised.
* The Maori Vested Land Act: Tribunals may determine disputes about the value of improvement on land returned to owners. This is a rarely exercised jurisdiction but there are currently a group of cases awaiting hearing in the Wanganui Tribunal.
* The Maori Reserve Land Amendment Acts 1997 and 1998: the Tribunal may determine land value for the purposes of Crown compensation to leasees or leasors of Maori land of capital loss when rent is increased.
Though only one tribunal member must be a registered valuer, generally both members are appointed for their valuation expertise. This expertise is the reason they are appointed to the tribunal to assist the Chair. The tribunal hears a range of expert evidence regarding valuation, and the function of the valuer-members is to bring critical analysis to the evidence and enable the tribunal to make a decision based in sound valuation practice.
