Appeal by Don Simcock
Dr Don Simcock is to appeal against convictions entered against him in the Auckland District Court this month.
In a statement issued through his lawyers, Dr. Simcock said he was confident of a successful outcome.
Dr. Simcock’s position argued before the District Court has been that he was involved with others in normal, and legal, business transactions. The true nature of the transactions which were independent of the Flat Rock Trust is not outlined in the District Court Judgment. The purpose of the appeal is to establish the clear legal nature of the transactions.
The District Court found that no loss was incurred by the trust or unit holders as a result of the matters which lead to the charges. The Court specifically noted that Dr Simcock had spent substantial personal funds on behalf of the Flat Rock Trust when it suffered as a result of the Asian crisis.
Dr Simcock was sentenced to community service on the three charges he faced.
No additional comment will be made due to the appeal.
