Media Statement From Subway Developments

Media Statement Issued By Bray 1 Ltd & Subway Developments
The Kelston Subway store reported to be paying its workers less than the minimum training wage has acknowledged they have received a letter from the Department of Labour yesterday regarding a complaint made by a former employee. Store owner, Mr Adrian Bray of Bray 1 Ltd says the complaint relates only to the rates paid to employees during their initial training.
Mr Bray says he will cooperate fully with the Department of Labour to decide if there has been an unintentional breach of the training wage and to ensure his employment contracts are fully compliant in every respect.
Mr Bray’s company recently employed Min Sheen Tan to work in the Kelston Subway store. Mr Tan started the company’s established formal training programme but did not complete it and quit after just three days on the job. Mr Tan told his employer he had not understood that the Subway training was not an NZQA qualification.
Subway development agent, Mark Rutherglen says the franchisee acted in good faith and was unaware that his employment contracts may be non compliant with current labour laws.
“We require all our franchisees to ensure their employment contracts are compliant and to act within the law but ultimately that responsibility is incumbent on every individual franchisee.”
