Coastal Area Bill – criteria for
success
BusinessNZ says the Marine and
Coastal Area Bill will have a high bar to clear in
fulfilling the aspirations of Maori and non-Maori
alike.
Chief Executive Phil O’Reilly says the Government’s efforts to consult widely on the Bill have been appreciated and it will be important that there is a sufficient period for further consultation and national debate.
“Hopefully the Bill can reach a successful conclusion in advancing the economic and social interests of Maori and non-Maori.
“For its part the business community will be looking at the Bill from a number of perspectives including economic development.”
He said BusinessNZ will judge the Bill to be a success if it:
1. Upholds and protects property rights
2. Facilitates economic development for Maori and non-Maori
3. Brings legal clarity and certainty
4. Integrates with other relevant legislation including the Resource Management Act
5. Is consistent with the terms of the Treaty of Waitangi and relevant common law
6. Satisfies overall justice and fairness including appeal rights and remedies
“Balancing competing needs with legislation of this kind inevitably involves trade-offs. It is to be hoped that we can all approach the debate around this Bill thoughtfully and courteously and without slogans.”
