A Smack For A Pat – And Employment Law About to Smell Worse!
Libertarianz Deputy Leader Richard is outraged at Justice Smellie’s decision to award a woman nearly $50,000 for having her bottom patted by her boss.
“That her boss was smacked so severely under the soon-to-be-historic Employment Contracts Act only makes me worry what sterner discipline might soon be exacted on errant employers under Ms Harre’s Employment Relations Bill. It would be laughable, except that the smacking could send the employer in question to the wall, and his employees into the dole queues."
Libertarianz has a suggestion for employees who are sexually harassed by their bosses: "Simply withdraw your labour," says McGrath. "Don’t put your fellow workers' jobs at risk by using the court system to sort out interpersonal problems. An employer who harasses his staff is a fool, and will pay the ultimate price by alienating good employees.”
"But the fact remains that hurt feelings don't constitute objective harm," says McGrath, "and the onus should be on the alleged victim in sexual harassment cases to prove that physical harm was actually done. I have no doubt however that the grossest harm done in coming months will not be by employers patting their staff, but by Ms Harre smacking employers. And that harassment will hurt us all,” says McGrath, “whether employer, or worker.”
