THOTT Decision

Child, Youth and Family says it has obtained obtain High Court orders freezing asset sales by Te Hauora O Te Tai Tokerau (THOTT) and placing severe restrictions on the use of the trust’s bank accounts.

“This excellent result in the court today means we can deal with the THOTT situation confident that High Court orders are preventing the disposal of assets and ensuring that THOTT funds can only be used for very limited purposes,” says CYF’s general manager of social work and community services Ken Rand.

CYF is claiming up to $1.7 million in damages from THOTT. A hearing is due later this month.

The orders made today with THOTT’s consent mean the trust cannot sell any assets before the next hearing and THOTT will only be able to make very limited use of its bank accounts and must inform CYF about what it is doing.
