RE International Commission of Jurists : A Zaoui

The Minister of Immigration, Ms L Dalziel, by letter dated 10.2.04, has responded to my report of the 6.2.04 by relying on the technical defense that the Warrant of Committment for Mr A Zaoui is signed by a District Court Judge and therefore is legal.

This has been forwarded to the ICJ who are meeting in Sydney on the 16th February to discuss the Zaoui case. They will consider the letter from Dalziel along with my report.

The only comment I will make in response is that I (and the other lawyers from the Auckland Bar who helped prepare the report) already considered those matters. Her letter does not change our view that Zaoui's continued imprisonment after the RSAA decision on the 1.8.04 is "prima facie unlawful".
