New Zealand Fire Service: Holidays Act Appeal

The Fire Service Commission filed an application this afternoon for leave from the Court of Appeal to appeal the Employment Court's recent judgment on the Holidays Act.

Fire Service Chief Executive Mike Hall said in deciding to appeal the judgment, the Commission considered a range of important organisational factors and sought extensive legal advice. Some of the legal issues were significant and related to the interpretation of the Holidays Act 2003, not only for the Fire Service but potentially for other employers.

"In the past two weeks I have had constructive discussions with the New Zealand Professional Firefighters' Union over the impact of the judgment. Despite the decision to appeal the judgment, I anticipate that these discussions will continue," Mr Hall said.
