JUDGMENT OF THE COURT A The application for leave to appeal is granted.

B The approved grounds of appeal are:

(i) Whether, consistently with the New Zealand Bill of Rights Act 1990, s 29 of the Racing Act 2003 authorised Thoroughbred Racing to make Rules of Racing relating to random drug testing of riders.

(ii) Whether Ms Cropp consented to provide her urine sample on 7 May 2005.

(iii) Whether by reason of the Rules and the Drug Testing Protocol For Riders Ms Cropp was lawfully required to provide that sample. Solicitors: Gibson Sheat, Wellington for Appellant Meredith Connell, Auckland for Respondents
