Code Of Practice “A Slap In The Face”

The Government has today announced a new Code of Practice for Retirement Villages, to replace the Code invalidated on a technicality by Judge France in the High Court. The Judge also gave a judgement that “The Act authorises the Code to alter existing contractual arrangements.”

This new Code however has given ‘a slap in the face” to residents.

The 2006 Code stated that refurbishment takes into account ‘fair wear and tear’ for all residents. The new Code is therefore ‘a slap in the face’ for many residents, as it states that fair wear and tear is only for those who became residents after 25 September 2006, whilst Judge France effectively recommended that it apply to all residents. The Judge’s refurbishment ruling has however been totally ignored.

Grey Power believes the new Code of Practice to be discriminatory to one section of the Community and should be immediately altered to include all residents, as effectively ruled by the Judge.
