"Another ludicrous ruling by one of our judiciary leaves many of us wondering where on earth we find our judges these days," said Kiwi Party leader Larry Baldock.

"One judge rules that the Boobs on Bikes parade should proceed and overturns the democratically elected Auckland City Council’s by-law, and now High Court Judge Denis Clifford rules that the police are to be ignored when they enforce the law, by ruling that ‘Mr Lowe's nakedness had not met the test of offensive behaviour.’

"In whose opinion, we might be entitled to ask? I know my wife, and I am pretty sure that she and the vast majority of women in this country would consider it offensive, but Justice Clifford say’s to be offensive it must cause anger, resentment or disgust. Well, Judge Clifford, I am pretty sure the female motorist that reported Mr Lowe to the police felt all three of those emotions," said Mr Baldock.

"You have to forgive many New Zealanders for wondering if the learned Judge might consider anything offensive!

"All this raises a very serious question for our nation and democracy. What slippery slide are we on morally when we pass laws that politicians then tell us to ignore, like the anti-smacking law, and Judges begin interpreting law by their own moral standard," he said?
