Submissions open on Employment Relations Amendment Bill

Submissions are open on the Employment Relations (Allowing Higher Earners to Contract Out of Personal Grievance Provisions) Amendment Bill

The bill proposes to amend the Employment Relations Act 2000 to allow employees with an annual gross salary over $150,000 to contract out of the personal grievance provisions.

Under this bill if the above option is taken, whatever the employee and the employer have agreed to in their employment contract stands. This removes the threat of personal grievance for the employer in exchange for agreed terms with the employee.

The agreement must be in writing, the employee must have the benefit of independent legal advice and the lawyer who gives the advice must certify that they have given the employee advice explaining the implications of the term before the employee signed the agreement.
